New bill in the House threatens citizenship

By Rebecca DiFede — As recently reported by NetRightDaily, the Senate passed the 2012 National Defense Authorization Act, a $662 billion Defense bill. It gives the military the power to lock up any and all suspected terrorists, whether captured here or abroad, and hold them indefinitely. Despite empty veto threats from our illustrious president, the bill passed 93-7.

Senate Intelligence Committee Chairman Dianne Feinstein (D-Calif.) and Lindsey Graham (R-SC) added in an amendment that guaranteed the current laws on the detention of citizens would stand, and in extreme cases the Supreme Court can decide if an exception would be granted. So at least if you were an American you would be somewhat protected from government locking you up and throwing away the key.

However, all that might be at stake. A new bill has been introduced that will override that amendment by allowing the government, upon suspicion of terrorist activity, to strip you of your citizenship (or naturalized status), disqualifying you from any and all the freedoms provided by the Constitution.

It is called The Enemy Expatriation Act (H.R.3166) and it is the stuff of nightmares. Introduced by Charles Dent [PA-15], and co-sponsored by Jason Altmire [PA-4], Robert Latta [OH-5] and Frank Wolf [VA-10], this bill allows the government to remove the nationality of anyone who the government says is participating in terrorist activity.  The Senate companion bill, S. 1698, was introduced by Sen. Joe Lieberman (ID-CT), with Sen. Scott Brown as its sole cosponsor.

People can come into your home, arrest you, strip you of your citizenship and detain you as long as they see fit because they suspect that you might be doing something they don’t like.

Speechless? You should be.

For the most part Americans have always agreed, that despite party ties, freedom was our main priority. “The land of the free and the home of the brave” was the one sentence everyone in America could count on to describe their country.

But now with the introduction of this new bill, it seems that the “land of the free and the home of the brave” is becoming “the land of the imprisoned and the home of those under suspicion”, which is probably not the future that our framers had in mind when they severed ties with the abusive King George III.

If this bill passes and goes to the President’s desk, the freedom and liberty that separates us from communist and fascist countries with brutal dictators will be in jeopardy. The rights given to us by the Constitution are practically the definition of what it means to be an American, and with our citizenship comes the guarantee that those rights will always be there to protect us.

But now some in our government, in their infinite wisdom, have decided to try and put an end to that freedom, and challenge the very fabric of our democracy by giving the power to revoke individuals national status to the government for having a mere suspicion of someone’s wrong-doings — without judicial review or due process.

Never before in our lifetimes has the government come so close to fully transforming into a dictatorship as it has now. The new defense bill, if coupled with this expatriation bill, makes me shudder at the thought of what else is hiding beneath our soon-to-be king’s well-guarded sleeves.

    So last week, you wrote a letter to the editor, denigrating Obuslims position on what the Constitution says about Recess Appointments when there is no recess.  This week a half dozen men in dark suits with ear buds knock on your door and deliver a notice to you that your natural born citizenship has been revoked and you’re going with them, because of your terrorist activities.

    I want to see my lawyer you reply.  Sorry, no lawyer for you, you’re told.  What are the specifics of the charge then, you ask.  We don’t need to tell you anything says the guy with the biggest bulge in his armpit.   We don’t even have to file a charge.  

    I have a right to see the charges against me and to have an attorney represent me, it says so in the Constitution, you say.  Sorry teabagger, only citizens have any Constitutional rights.

    You are never seen or heard from again.

    Obama and  his CZARS are doing exactly what they said they were going to do:  “Fundamentally transforming America”.  I say, “LET THE REVOLUTION BEGIN”.  I pray every day Obama is not re-elected because if he is, America as we know it, will be 100-percent GONE!  We must reunite as a nation and get back on track and we must keep telling our elected officials that they WORK FOR US…WE DO NOT WORK FOR THEM!  I I urge everyone to write, write, write, call, call, call, your Senators and Congressmen/women and voice your concerns.  I do this on a regular basis.  Sometimes I get a response and sometimes I do not, but if enough of us do this, we will have a great impact!

    Look back a little in our history. Roosevelt did the same thing by executive order when he rounded up citizens, stole their property & money, no trials and all went to internment camps. What happened to the Stolen Property & Money, well you guess as I surmise that is all went into the pockets of Roosevelt’s buddies. So It has been done and presently these ruler are rebuilding more prison camps for you and I. Of course if these Shadow Governments do not murder us first. Like the FDA(Murder for Profit Inc.) which approves deadly poison drugs and thousands of toxins for the foods you eat.

    Can the paranoia of the federal government get any worse? The are so afraid that their power base is in jeopardy that they are resorting to these gross violations of human rights. The constitution does not grant anybody these rights, they are FROM GOD and not granted by MEN!

    well, Rebecca – welcome to the party! You’re only about 10 years late. The NDAA bill was bad, and this one’s worse, but – Guess what? All this was already in place with the Patriot act which came into being under Republican rule after 9/11. I assume you hadn’t heard of “rendition” going on for ten years now? Now why the fuss and no fuss then? Or maybe you did fuss, but i’d guess not since you’re not bringing it up. 

    Get this: When there is no due process for some people, there is no due process for anyone. Under the Patriot act and NDAA, if you are picked up as a terrorist, you lost all your constitutional rights. What if you’re a citizen? Well, prove it! Oh – for that I need access to the courts, lawyers, etc., but I have no right to due process, habeas corpus doesn’t apply. Or are you so trusting of our great government that they would NEVER make a mistake and call a citizen a terrorist in ignorance of the fact they’re a citizen? 

    Oh – I bet you don’t believe this. However, it’s already happened. Padilla was a US citizen who was picked up under the terrorism laws. Eventually it because well known that he was a citizen – he was LUCKY – so they were all set to challenge his detention under the Homeland Security laws, when, guess what, Bush decided he could be tried in civil courts after all. The judge in the case was furious, saw this as just an end-run, but there was nothing he could do. And, I wonder, would the right wing nut crew have denounced him as an activist judge? I think there’s a pretty good likelihood of that.

    So, why don’t you write the REAL article you should be writing, which is that, when it comes to the bottom line, this is nothing new at all. It’s all been in place since the Patriot Act. NDAA was just some housekeeping – do we get the defense dept involved or do we have police who protect us, in the US, from lawbreakers. Let me guess why: This gives you a chance to trash Obama (who does deserve trashing for this) instead of Bush and the Republican congress who passed the monster in the first place. And, yes, I know, a lot of liberals and Democrats voted for the Patriot and NDAA, too. 

    How’s about if you comment on your timing, in light of the above?

    I could’t believe that this vill was passed be 110  republican house members and 93 senators.  I have yet to hear from my house representative but have heard from both of my senators (Minnesota).  Al Franken wrote me and told me he voted NO on the bill because of Amendment 1031 which outlines the right of the government to designate anyone as a threat to the U.S. and be arrested and held indefinitely.  That is exactly what the Amendment does.  Amy Klobuchar wrote me and said she voted YES on the bill because it really did not state that the government could or would do such a thing.  She blatently lied to me and I called her on it in a letter I mailed to her, return receipt requested.  I can’t wait for her response. I basically told her that he has been hanging around Obama too long and may have taken his LYING 101 course.  My house rep, Erik Paulsen, also voted YES and I mailed him a letter today asking him to “spin” his reasoning.  The bill nullifies our 4th Amendment rights to the Constitutiion and need to be heard br the U.S. Supreme Court.

    Our only hope is that those in the House are Constitutionalists and honor the oath they took upon entering office. Should these representatives sign this bill then it is beyond time we rid ourselves of these self serving, blood sucking, hands in your pockets, and Spending OUR TAX MONIES on things other than what is needed right here at home.      The Enemy Expatriation Act (H.R.3166) – You who are the constituents of the Representatives who sponsored this stupid bill should email them, Fax them with your opposition, over and over again. Check to learn if any are up for reelection 2012, and let them know they won’t have your vote! Send them all a strong message! They are getting worse and worse, acting like communists! Don’t forget to also enlighten Lieberman and Brown. They should know better. They represent states that were a part of the Revolution to win their Freedom from tyranny.  H.R.3166 is much worse than the original Patriot Act. Everyone send emails to Rep. Charles Dent, Jason Altmire, John Latta and Frank Wolf. We keep saying ‘they work for us’, and if so, then WE should be communicating with THEM, and telling them how to do the job! WE pay them, and they should always be aware that they can be ‘fired’.  Marlene and Dean are exercizing their Rights. We all should. But he’s not the cause of all this crap, or even most of it; it began years ago right after 9/11 when we decided to trade our freedom for safety with the Patriot act. The senate just passed NADD or whatever it is 93 to 7. I would be willing to bet you couldn’t pass a resolution in favor of motherhood and apple pie with a majority like that. Certainly they never gave Obama anything he wanted, so you know where the blame lies. The problems go far beyond Obama, so keep your eye on the ball and don’t miss the real enemies. The bush white house (alberto gonzales) tried to turn the dept of justice into a political machine to get republicans elected. I think it’s sad that all this vitriol is coming out now, when this crap has been flying for years. Yeah, i know.     Almost every week there are published news accounts of Police Corruption, e.g. Police taking bribes, aiding & smuggling illegal drugs, robbing drug-dealers and committing perjury. ALERT! Perjury by police and their informants may now pose the greatest threat to Americans’ Freedom due to Congress in December 2011 passing (NDAA) The National Defense Authorization ACT of 2012. Under (NDAA) Government does not need probable cause or corroborating evidence to Indefinitely Detain Americans without charges, no right to an attorney, trial or Habeas Corpus; Police that falsify reports and give perjured testimony can now cause innocent Americans to be swept off the street and indefinitely incarcerated for being a suspected terrorist or supporting Terrorism: Note no violent act is required to be charged with involvement in terrorism under (NDAA).

    Currently there are several Multi-State Recall Petitions of Congressman that voted for The National Defense Authorization ACT of 2012.

    Some observers believe NDAA included the vague term “Belligerent” in the manner it did, so U.S. Government would have authority granted by Congress to Indefinitely Detain large numbers of Americans not involved in terrorism. Under NDAA, U.S. Government can deem anyone a “Belligerent” for indefinite detention. The term “Belligerent” is so expansive and vague an American Citizen could be labeled a “Belligerent” for exercising First Amendment Rights—speaking out for or against any issue; protesting a U.S. Government Policy; agency or coalition Partner. It is foreseeable U.S. Government will threaten Americans with Indefinite Detention that refuse to act as informants. The East German Stasi Police used this tactic to create an army of neighborhood and other informants.

    The passed (Defense Authorization Act of 2012) appears more threatening to Americans than (Hitler’s FASCIST 1933 Discriminatory LAWS) that suspended provisions in the Reich Constitution that Protected German Citizens’ Civil Liberties? For example—Hitler’s 1933 DISCRIMINATORY LAWS (stated fines and time limits) that German Citizens could be incarcerated for e.g., Serious Disturbance of the Peace, Provoking Public Unrest, Rioting; Acts that threatened National Security. In contrast Senators John McCain and Carl Levin’s passed National Defense Authorization Act of 2012—mandates holding Americans’ (Indefinitely) in Military Custody for being a mere “Belligerent.”

    Under the passed National Defense Authorization, could some Americans (Retroactively) be subject to Indefinite U.S. Military or Prison Detention without charges or right to an attorney or trial? Consider most American activists don’t know what other activists and groups they networked or associated did in the past—perhaps illegal. Both the National Authorization Act of 2012 and USA Patriot Act are expansive and vague—what constitutes (1) supporting or aiding terrorists, (2) a terrorist act; (3) when someone is a “Combatant” or (4) “a Belligerent.” For example, Americans advocating, attending or supporting a meeting or protest demonstration against a U.S. Government Agency; Policy or U.S. Military Action—could be charged with (1) (2) (3) and (4) under NDAA and the Patriot Act.

    History Repeats: When other countries passed Police State Laws like The Defense Authorization Act of 2012, Citizens increasingly abstained from politically speaking out; visiting activist websites or writing comments that might be deemed inappropriate by their Police State Government, e.g. cause someone to lose their job; be investigated; disappeared and or detained in Police/Military Custody. Some writers might be dead-meat under NDAA. It appears that “Americans” who write on the Internet or verbally express an opinion against any entity of U.S. Government or its coalition partners—may under the Patriot Act or The Defense Authorization Act—be deemed by U.S. Government (someone likely to engage in, support or provoke violent acts or threaten National Security—to order an American writer’s indefinite military or prison detention.

    Is NDAA Retroactive? Can U.S. Government invoke provisions of NDAA or the Patriot Act to assert a U.S. Citizen’s past or current writings (protected by the 1st Amendment) supported or aided terrorists, provoked combatants or belligerents as a premise to order an author’s Indefinite Detention? The Defense Authorization Act of 2012 did more than Chill Free Speech—it may FREEZE IT! Consider: In mid-January 2012 Homeland Security announced the National Operations Center (NOC) received permission from Washington to monitor journalists and retain data on users of social media and online networking platforms. Could this Homeland Security spying, tracking Americans result in Citizens abstaining from visiting and posting comments on websites?     It should be expected that indefinitely detained U.S. Citizens not involved in terrorism or hostile activities, not given Miranda Warnings when interrogated or allowed legal counsel; will also be prosecuted for non-terrorist (ordinary crimes) because of their (alleged admissions) while held in Indefinite Detention.

    Well we now know without a shadow
    of a doubt that we have become Hitler’s Germany.   I grew up in the United States of America
    where I said the Pledge of Allegiance with my hand over my heart every school
    day.  I stood up for the national anthem
    because I was proud of my country and I was taught to be proud.  We had a short devotion and prayer every
    morning and everyone participated in it. 
    We had no drugs, no alcohol problems with the kids, and no drive by
    shootings, no children murdering each other, or raping each other.  We respected our elders and our teachers.  We went to church and study our Bible.  We had good grades and high to average scores
    on all national tests.

    Now  in the past 50 to 60 years we put GOD out of
    our schools, we have drugs and alcohol problems with kids, drive by shooting by
    kids, we have kids murdering and raping each other, kids do not respect their
    parents, elders, or teachers, kids do not go to church or study the Bible  We have people in Congress that are card
    carrying Socialist, a few atheists, a couple of Muslims, most are insider
    trader, liars, cheats, and now they are voting to have our military to come
    into our homes if the government does not agree with our opinions and then take
    away our freedom and our citizenship. Heil Hitler!  GOD have mercy on our country, please.

    One can’t help recall that before Hitler, German Civilian
    and State Police worked for a Free German Republic and subsequently under
    Hitler did not resist working for the Nazi fascist government or Hitler’s
    Gestapo to terrorized lawful Germans; and following World WAR II many of the
    same German police went to work for the East German Stasi considered the
    world’s most oppressive police force under the USSR. History repeatedly shows
    police generally don’t resist switching their employment from a free society to
    being employed by fascist or communist governments as long as they get paid.

     

    After Hitler got passed his 1933 Discriminatory Laws that
    suspended German Citizens’ Constitutional Protections similar to America’s
    National Defense Authorization Act of 2012 the police did not quit. See

    Hitler’s laws stated prison time for offenses. Note The U.S. NDDA can hold
    Americans in Indefinite Detention for being a mere “belligerent.”

    the following is decreed as a defensive measure against Communist acts of
    Violence, endangering the state:

     

    Section 1

    Sections 114, 115, 117, 118,
    123, 124, and 153 of the Constitution of the German Reich are suspended until
    further notice.
    Thus, restrictions on personal liberty, on the right of free expression of
    opinion, including freedom of the press, on the right of assembly and the right
    of association, and violations of the privacy of postal, telegraphic, and
    telephonic communications, and warrants for house-searches, orders for
    confiscations as well as restrictions on property, are also permissible beyond
    the legal limits otherwise prescribed.

     

    Section 2

    If in a state the measures necessary for the restoration of public
    security and order are not taken, the Reich Government may temporarily take
    over the powers of the highest state authority.

     

    Section 4

    Whoever provokes, or appeals for or incites to the
    disobedience of the orders given out by the supreme state authorities or the
    authorities subject to then for the execution of this decree, or the orders
    given by the Reich Government according to Section 2, is punishable—insofar as
    the deed, is not covered by the decree with more severe punishment and with
    imprisonment of not less that one month, or with a fine from 150 up to 15,000
    Reich marks.

     

    Who ever endangers human life by violating Section 1, is to
    be punished by sentence to a penitentiary, under mitigating circumstances with
    imprisonment of not less than six months and, when violation causes the death
    of a person, with death, under mitigating circumstances with a penitentiary
    sentence of not less that two years. In addition the sentence my include
    confiscation of property.

     

    Whoever provokes an inciter to or act contrary to public
    welfare is to be punished with a penitentiary sentence, under mitigating
    circumstances, with imprisonment of not less than three months.

     

    Section 5

    The crimes which under the Criminal Code are punishable
    with penitentiary for life are to be punished with death: i.e., in Sections 81
    (high treason), 229 (poisoning), 306 (arson), 311 (explosion), 312 (floods),
    315, paragraph 2 (damage to railroad properties, 324 (general poisoning).

    Insofar as a more severe punishment has not been previously
    provided for, the following are punishable with death or with life imprisonment
    or with imprisonment not to exceed 15 years:

     

    1.            Anyone who undertakes to kill the Reich President or a member or a
    commissioner of the Reich Government or of a state government, or provokes to
    such a killing, or agrees to commit it, or accepts such an offer, or conspires
    with another for such a murder;

    2.            Anyone who under Section 115 (2) of the Criminal Code (serious rioting)
    or of Section 125 (2) of the Criminal Code (serious disturbance of the peace)
    commits the act with arms or cooperates consciously and intentionally with an
    armed person;

    3.            Anyone who commits a kidnapping under Section 239 of the Criminal with
    the intention of making use of the kidnapped person as a hostage in the
    political struggle.

    Section 6

     

    This decree enters in force on the day of its
    promulgation.

    REMEMBER…..  The Japanese-Americans who were arrested without trial by jury and held for an indefinite time in American concentration camps here in America during WWII ?
       Obama threatened to veto the bill until Congress gsve the president the authority to declare all of America a military zone….. when he got that authority, he signed the bill into law.  December 31, 2011…. the last day of the year.
